An American Legion Post in Noble County has filed a federal lawsuit against Indiana's smoking ban which takes effect July 1st. It bans smoking in most places of employment, including restaurants, but not bars.
Nonprofit private clubs and fraterna groups can vote to allow smoking, though people younger than 18 must be in an enclosed area with ventilation. The groups must then vote every two years to allow smoking to continue in their establishment.
American Legion Post No. 243 argue the ban is too vague, violates equal protection cluases of the U.S. and Indiana Consitutions, and violates a freedom of conscience measure in the state's constitution.
